GIVEWE.com (“Platform”, “We”, “Us”, “Our”). By accessing or using our website, services, or mobile applications, you (“User”, “Donor”, “Campaign Creator”, “Beneficiary”) agree to be bound by these Terms and Conditions. Please read them carefully.

1. About the Platform (Social Enterprise Model)

  • 1.1 Structure: GIVEWE.com is a technology-driven Social Enterprise platform operated as an independent business entity. We act solely as an intermediary/technology enabler connecting campaigners in need of medical or social funds with prospective backers and donors.
  • 1.2 Non-NGO Status: GIVEWE is NOT an NGO, Non-Profit Organization, Charitable Trust, or Society.
  • 1.3 Tax Exemption Disclaimer: Donations made through GIVEWE are NOT eligible for 80G tax exemptions or any other charitable tax deductions under the Income Tax Act of India.

2. Campaign Creation & Beneficiary Verification

  • 2.1 Document Submission: Campaign Creators must provide genuine KYC documents (Aadhaar/PAN), verified hospital estimates, medical certificates, and bills before a campaign is published.
  • 2.2 Authorization & Consent: By creating a campaign, the creator explicitly authorizes GIVEWE to verify all submitted documents directly with hospitals, doctors, and legal authorities.
  • 2.3 Misrepresentation & Fraud: Submitting fake documents, inflated bills, or misleading information will lead to immediate campaign suspension, legal action, and reporting to law enforcement authorities.

3. Financial Flow & Fund Disbursement

  • 3.1 Payment Processing: All contributions made on the platform are processed through secure, third-party payment gateways linked to GIVEWE’s platform account.
  • 3.2 Direct Hospital/Service Provider Transfer: To ensure 100% financial transparency and prevent fraud, funds raised for medical emergencies will be disbursed directly to the verified bank account of the Hospital, Pharmacy, or Treatment Facility, and NOT to the personal account of the campaigner (unless exceptional emergency conditions are approved).
  • 3.3 Platform Sustainability & Fee Structure:
  • Voluntary Platform Tips: Donors may choose to add an optional voluntary “tip” or contribution to GIVEWE at checkout to support our operational, verification, and hosting costs.
  • Administrative Fee: GIVEWE reserves the right to deduct a nominal platform/administrative fee (as disclosed on the campaign setup page) and payment gateway processing charges prior to fund disbursement.

4. Donor Responsibilities & Refund Policy

  • 4.1 Voluntary Contributions: All contributions made through GIVEWE are voluntary and made at the donor’s sole discretion.
  • 4.2 Refund Policy: Due to the emergency nature of crowdfunding, donations are non-refundable once funds have been disbursed to the hospital or beneficiary. Refunds are only issued if a campaign is proven fraudulent prior to disbursement.
  • 4.3 Payment Acknowledgements: Donors will receive a digital Payment Acknowledgement / Gratitude Receipt. This serves as proof of payment but cannot be used for tax deduction purposes.

5. Intellectual Property & Marketing Use

  • 5.1 Content Usage: Campaign creators grant GIVEWE a non-exclusive, worldwide, royalty-free license to use campaign stories, photos, and video updates for marketing, social media promotion, and transparency reporting.
  • 5.2 Privacy: User data is managed strictly according to our Privacy Policy. Personal data will never be sold to third parties.

6. Limitation of Liability

  • 6.1 No Medical Advice: GIVEWE is a crowdfunding platform and does not offer medical advice, diagnostics, or treatment guarantees.
  • 6.2 Platform Availability: While we strive for 100% uptime, GIVEWE is not liable for temporary technical outages, payment gateway downtime, or third-party server issues.

7. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the platform shall be subject to the exclusive jurisdiction of the courts in Odisha, India.
